Terms & Conditions – Media Conversion Services

These Terms & Conditions apply to all Super 8, VHS, VHS‑C and other analogue media conversion services provided by Somers Design ("we", "us", "our"). By submitting media to us for conversion, you agree to the following terms.

1. Scope of Services

We provide conversion of analogue media formats including:

• Super 8 film
• VHS
• VHS‑C

into digital formats for private, personal use only. Services include playback, capture, basic quality checks, and delivery of digital files in an agreed format.

2. Ownership & Copyright

You confirm that:

• You are the legal owner of the media submitted or have the legal right and permission to request a digital copy.
• The conversion is requested for personal, private use only.

We do not grant permission to copy, distribute, sell, upload, broadcast, or publicly share converted material.

We reserve the right to refuse conversion of any media that we reasonably believe infringes copyright or intellectual property laws.

3. Prohibited & Illegal Content

We do not accept or process media containing illegal material.

If, during the course of conversion, we encounter content that appears to be illegal — including but not limited to child sexual abuse material — we are legally required to:

• Immediately cease processing
• Secure the original media
• Report the matter to relevant law enforcement authorities

No converted files will be supplied in such circumstances.

4. Sensitive or Offensive Content

Your media may contain sensitive, disturbing, or explicit material.

• We do not actively review content beyond what is reasonably required for quality control.
• We reserve the right to refuse or stop work on any media at our discretion.
• No refunds will be provided for work already completed prior to refusal.

5. Privacy & Confidentiality

We treat all customer media and digital files as confidential.

• Media and digital files are accessed only for the purpose of conversion.
• We do not copy, share, publish, or use your content for any purpose other than providing the requested service.
• Digital files are securely stored during processing.

Unless otherwise agreed in writing, all digital files are deleted within 14 days after delivery.

6. Handling of Original Media

While we take reasonable care when handling your media:

• Analogue tapes and film may be fragile, degraded, or damaged due to age.
• Playback may involve inherent risk to old or brittle media.

We are not responsible for:

• Pre‑existing damage
• Degradation during normal playback
• Loss of quality caused by the original recording

7. Quality & Limitations

You acknowledge that:

• Digital files reflect the quality of the original media
• Issues such as colour fading, tracking problems, dropouts, distortion, or audio issues may be present
• Restoration or enhancement services are not included unless explicitly agreed

We do not guarantee improvement of original quality.

8. Delivery & Storage Media

Digital files may be delivered via:

• USB drive
• External hard drive (customer supplied or purchased)

Cloud-based delivery or storage is not provided by default and may be discussed and agreed upon separately upon request.

Ownership of supplied storage media transfers to the customer once payment is completed.

9. Turnaround Times

Turnaround times are estimates only and may vary based on:

• Volume of media submitted
• Condition of tapes or film
• Equipment availability

We are not liable for delays beyond our reasonable control.

10. Pricing & Payment

• Prices are quoted based on format, duration, and condition of media
• Payment is required prior to release of converted files
• Additional charges may apply for severely damaged media or special handling but this would be discussed prior to any additional charges.

11. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the cost of the service provided
• We are not liable for indirect, incidental, or consequential loss

Nothing in these terms excludes rights under Australian Consumer Law.

12. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia, and any disputes will be subject to the jurisdiction of Victorian courts.
